OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU HAVE PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU, AND NOTHING IN THESE TERMS SHALL LIMIT RIGHTS THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
10. Account Termination and Deactivation
The Service does not currently require visitors to create an account, and no personal account is necessary to read our content. In the event that account-based features are introduced in the future, these provisions shall apply: you are responsible for safeguarding any login credentials and for all activity that occurs through your account. If the matter is not resolved within thirty (30) days, you and Vortela agree to attempt in good faith to resolve any dispute, controversy, or claim arising out of or relating to these Terms or the Service through individual, binding arbitration conducted in accordance with the commercial arbitration rules of the American Arbitration Association, if and to the extent such rules are applicable. Either party may instead seek injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect its intellectual property rights or confidential information. You agree that any dispute arising under these Terms will be resolved on an individual basis only, and you waive any right to participate in a class action or class-wide arbitration.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States of America, without regard to its conflict-of-law provisions, and to the extent applicable, the federal laws of the United States. You agree that any legal suit, action, or proceeding arising out of or relating to these Terms or the Service shall be instituted exclusively in the state courts located in King County, Washington, or the United States District Court for the Western District of Washington, and you irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection based on improper venue or forum non conveniens. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
14. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will make reasonable efforts to provide at least thirty (30) days' notice of material changes before the revised Terms take effect, by posting a notice on the Service or updating the "Last updated" date above.
